Terms of Use

1. Agreement to Terms

By downloading, installing, and using Anchor: Daily Intention ("the App"), you agree to be bound by these Terms of Use ("Agreement"). If you do not agree to these terms, do not use the App.

Anchor: Daily Intention is provided by Shimon Deitel ("Developer," "we," "us," or "our").

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal iOS device(s) for your personal, non-commercial use only.

This license does not permit you to:

• Distribute or sell the App
• Modify, reverse engineer, decompile, or extract the App's source code
• Use the App for commercial purposes without explicit written permission
• Create derivative works based on the App
• Rent, lease, or lend the App to others

3. Intellectual Property Rights

All content, features, and functionality of the App (including but not limited to design, text, graphics, logos, icons, and source code) are the exclusive property of the Developer and are protected by international copyright, trademark, and other intellectual property laws.

Your intentions and personal data belong to you. You retain all ownership rights to the content you create within the App.

4. Acceptable Use

You agree not to use the App in any manner that:

• Violates any applicable law or regulation
• Infringes upon the rights of others (intellectual property, privacy, publicity)
• Contains malware, viruses, or harmful code
• Harasses, bullies, or threatens others
• Is sexually explicit, defamatory, or promotes violence or illegal activity
• Disrupts the normal operation of the App

5. User Accounts

To use most features of the App, you must create an account using Sign in with Apple.

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree not to share your Apple ID or account access with others.
• You are responsible for all activities that occur under your account.
• You must be at least 13 years old to create an account (or the age of digital consent in your jurisdiction), or have parental/guardian consent.

6. In-App Purchase (Pro Unlock – $0.99)

Anchor offers an optional Pro unlock for $0.99 (non-consumable, one-time purchase).

Pro Features:

• Additional card themes (Ink, Paper, Sky) for sharing
• Streak freeze: once per calendar month, one missed day is forgiven
• Export intentions as text or PDF (last 1 year)

Billing & Refunds:

• The purchase is processed securely by Apple through StoreKit 2.
• Your receipt is issued by Apple, not the Developer.
• Refund requests must be submitted to Apple through the App Store.
• The Developer does not handle refunds directly.

7. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• TITLE

The Developer does not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• Defects will be corrected
• The App is free of viruses or harmful components

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR:

• Direct, indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, use, or goodwill
• Business interruption
• Any damages arising out of your use or inability to use the App

This limitation applies even if the Developer has been advised of the possibility of such damages.

9. Data Loss & Backup

While the App stores your intentions locally and syncs them to your iCloud account for redundancy, you are responsible for maintaining your own backups of important data.

The Developer is not liable for:

• Loss or corruption of your intentions due to device failure, data corruption, or iCloud sync errors
• Accidental deletion of your intentions
• Downtime or service interruptions from Apple's CloudKit infrastructure

10. Termination

By You: You may stop using the App at any time by uninstalling it from your device and signing out from Settings.

By Developer: The Developer may terminate or suspend your access to the App or your account if:

• You violate these Terms of Use
• You engage in illegal or harmful conduct
• The App is discontinued or a feature is removed

Upon termination, your license to use the App ends immediately. You may lose access to your intentions if your account is deleted, although you have the option to export your data before deletion.

11. Changes to the App

The Developer reserves the right to:

• Modify, update, or improve the App
• Add, remove, or change features
• Discontinue the App or any feature with reasonable notice

The Developer will not be liable for any loss or damage resulting from changes to the App.

12. Governing Law & Jurisdiction

These Terms of Use are governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law principles.

You agree that any legal action or proceeding arising under these Terms shall be brought exclusively in the competent courts located in Tel Aviv, Israel, and you consent to the personal jurisdiction and venue of such courts.

13. Arbitration & Class Action Waiver

Except where prohibited by law, you and the Developer agree that:

• Any dispute shall be resolved by binding arbitration under the American Arbitration Association (AAA) rules (or equivalent in your jurisdiction).
• Arbitration shall be conducted on an individual basis only, not as a class action or representative proceeding.
• You waive the right to a jury trial and the right to participate in class action lawsuits.
• The arbitration shall take place in Tel Aviv, Israel.

Notwithstanding the above, you may pursue disputes in small claims court if they qualify under your jurisdiction's rules.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be reformed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and the Developer regarding your use of the App, and supersede all prior agreements and understandings.

16. Modifications to Terms

The Developer may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last updated" date and, if required, providing notice in the App.

Your continued use of the App after changes constitutes your acceptance of the updated Terms.
